Action to recover damages for personal injuries. Judgment in favor of plaintiff, entered on the verdict of a jury, and order setting aside the verdict as to defendant Herbert Construction Co., Inc., and dismissing the complaint as to such defendant, insofar as appealed from, unanimously affirmed, with costs.
