Vernonville Farms, Inc. v. Nelson Creamery Corp.
Appellate Division of the Supreme Court of New York · Decided March 7, 1945
269 A.D. 719; 54 N.Y.S.2d 694; 1945 N.Y. App. Div. LEXIS 3439
Vernonville Farms, Inc. v. Nelson Creamery Corp.

Opinion of the Court

Appeal by defendant, from a judgment entered on the verdict of a jury dismissing a counterclaim. The evidence sustains the verdict and there was no error which requires reversal. Some of the statements made by counsel for plaintiff-respondent in the summation were unwarranted. While appellant’s counsel objected, he requested admonition by the court, but stated that he did not desire a mistrial. Judgment affirmed, with costs. All concur. [See post, p. 791.]
