Simms v. Simms

Order so far as appealed from unanimously modified by granting item 5 of the notice of motion.- Defendant, however, is not required to produce upon the examination a copy of his Federal or State income tax returns for any of the years in question. As so modified the order appealed from is affirmed, without costs. No opinion. The date for the examination to proceed to be fixed in the order. Settle order on notice. Present — Martin, P.
