Order, so far as appealed from, unanimously reversed, with $20 costs and disbursements to the appellant, and the matter referred to an official referee to determine the issues as to the making of the contract and the question of consideration therefor, without prejudice to an application by the defendant in the meantime to amend the judgment nunc pro tunc.
