Order reversed on the law, with $10 costs and disbursements, and motion granted, with $10 costs, with leave to plaintiff to plead over within twenty days, if so advised. Memorandum: On the record we are unable to determine definitely the date on which plaintiff claims that the agreement to sell the real property was made. All concur.
