Judgment of a city magistrate, holding a court of Special Sessions of the City of New York, Borough of Brooklyn, convicting defendant of a violation of subdivision 2 of section 65 of the Alcoholic Beverage Control Law (selling alcoholic beverage to intoxicated person), reversed on the law, the *1033information dismissed, and the fine remitted. Defendant’s guilt was not established beyond a reasonable doubt. Hagarty, Acting P. J., Carswell, Johnston, Adel and Sneed, JJ., concur.
