Opinion of the Court

Action to construe the provisions of the last will and testament of Florence Halsey, deceased. The legatee Miele appeals from so much of the decree of the Surrogate’s Court, Dutchess County, as construes the Second ” and " Twenty-seventh ” paragraphs of the will of the testatrix. Decree, insofar as appealed from, unanimously affirmed, with costs, payable out of the estate, to each party filing briefs. No opinion. Present — Hagarty, Acting P. J., Carswell, Nolan and Sneed, JJ.
