Appeal from an order of the Appellate Term, by permission, which unanimously reversed on the law and the facts a judgment in favor of the plaintiff, previously entered in the Municipal Court after a jury trial, and granted a new" trial. Order of the Appellate Term unanimously affirmed, with costs, and, in accordance with the stipulation heretofore filed herein by the plaintiff, judgment absolute is directed for the defendant.
