Judgment reversed on the law, with costs, and complaint dismissed, with costs. Certain findings of fact' disapproved and reversed. Memorandum: In our view the contract of September 15, 1944, was one for.the personal services of Joseph E. Du Bois which terminated upon his death. All concur, except McCurn and Love, JJ., who dissent and vote for affirmance. (The judgment is for plaintiff in an action for an accounting.) Present — Taylor, P.
