Opinion of the Court

Under the circumstances of this case we see no necessity for engagement of outside counsel by the committee who was an attorney. Accordingly, the allowance to the attorneys should be stricken. The order appealed from is unanimously modified accordingly by striking out the allowance to the attorneys retained by the accounting committee and as so modified affirmed, without costs. Settle order on notice. Present — Peck, P. J., Glennon, Dore, Cohn and Callahan, JJ.
