Claim of La Violette v. Chisholm Ryder Co.
274 A.D. 1077; 86 N.Y.S.2d 290; 1949 N.Y. App. Div. LEXIS 6134
Opinion of the Court
Appeal from a decision of the Workmen’s Compensation Board disallowing a claim for death benefits. There is evidence to support the conclusion that the decedent’s death was not due to an accidental injury within the meaning of the Workmen’s Compensation Law. The obvious error in the findings is inconsequential and does not go to the merits of the case. Decision unanimously affirmed, without' costs. Present — Foster, P. J., Brewster, Deyo, Santry and Bergan, JJ. [See 275 App. Div. 725.]
