Opinion of the Court

No opinion. Present — Peek, P. J., Glennon, Callahan, Van Voorhis and Shientag, JJ.; Shientag, J., dissents and votes to reverse, with leave to serve an amended complaint on the ground that, in its present form, the complaint is insufficient in law.
