Opinion of the Court

In an action to recover damages for personal injuries suffered by plaintiff’s intestate, order denying defendant’s motion to set aside the verdict and for a new trial on the ground of newly discovered evidence, reversed on the law and the facts and the motion granted, costs to abide the event. Under all the facts and circumstances the motion should have been granted. Johnston, Acting P. J., Adel, Sneed, Wenzel and MaeCrate, JJ., concur.
