Levine v. Lozea
Levine v. Lozea
278 A.D. 636; 102 N.Y.S.2d 1016; 1951 N.Y. App. Div. LEXIS 4165
Opinion of the Court
A review of all the evidence, particularly the writings, leads us to conclude that the finding of the jury to the effect that plaintiffs had brought about a meeting of the minds between the purchaser and the seller on all essential terms of the transaction is contrary to the weight of the credible evidence. Judgment unanimously reversed and a new trial ordered, with costs to the appellant to abide the event. Present — - Peck, P. J., Cohn, Callahan, Van Voorhis and Shientag, JJ.
