11 A.D.2d 752; 201 N.Y.S.2d 550; 1960 N.Y. App. Div. LEXIS 9331
Abbott v. Pirie

Opinion of the Court

— Judgment and order unanimously reversed on the law and facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict of the jury was against the weight of evidence. (Appeal from judgment and order of Monroe Trial Term for defendants for no cause of action. The order denied plaintiff's motion for a new trial, in an automobile negligence action.) Present — Williams, P. J., Bastow, Halpern, McClusky and Henry, JJ.
