In an action .to .recover possession of real property, the landlord, by permission of the Appellate Term, appeals from its'order, made February 2,1960, affirming the final order of the Municipal Court of the City of New York, entered July 7, 1959, dismissing the petition. Appeal discontinued, without costs, upon the written stipulation and consent of the parties, dated April 2-7, 1961. Nolan, P. J., Beldoek, Ughetta, Kleinfeld and Brennan, JJ., concur. .....
