Order entered on November 10, 1961, denying defendant’s motion to dismiss the second amended complaint, unanimously affirmed, with $20 costs and disbursements to the respondent. The sole ground advanced was that the matters set forth in the complaint are exclusively within the jurisdiction of the National Labor Relations Board. Concur — Rabin, J.
