26 A.D.2d 684; 272 N.Y.S.2d 741; 1966 N.Y. App. Div. LEXIS 3642
People v. Dunaeff

Opinion of the Court

Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered December 6, 1965, convicting him of attempted robbery in the third degree, upon a plea of guilty, and sentencing him to serve 2% to 5 years. Judgment modified, on the facts, by reducing the sentence to 1 to 2 years. As so modified, judgment affirmed. In our opinion, under all the circumstances, the sentence was excessive. Ughetta, Acting P. J., Christ, Hill, Rabin and Benjamin, JJ., concur.
