Claim of Mance v. Washington Refrigeration Corp.
Appellate Division of the Supreme Court of New York · Decided June 24, 1971
37 A.D.2d 637; 322 N.Y.S.2d 1017; 1971 N.Y. App. Div. LEXIS 3738
Claim of Mance v. Washington Refrigeration Corp.

Opinion of the Court

Appeal from a decision of the Workmen’s Compensation Board, filed May 8, 1969, which disallowed a claim for compensation under the Workmen’s Compensation Law. There was substantial evidence supporting the board’s decision that the injuries sustained by claimant did not arise out of and in the course of employment and the questions of credibility were within the province of the board. Decision affirmed, without costs. Herlihy, P. J., Staley, Jr., Greenblott, Cooke and Sweeney, JJ., concur.
