The notice of appeal was filed herein prior to the signing or entry of the judgment, but this court has treated the notice as valid (CPLR 5520, subd. [c] ) and the notice is hereby amended to show the correct entry date of judgment, i.e., September 27, 1973, instead of October 27, 1972. Rabin, P.
