— Application pursuant to CPLR 7002 (subd [b], par 2) for writ of habeas corpus denied on the ground petitioner’s double jeopardy contentions are without merit (see, e.g., Matter of Napoli v Supreme Ct. of State of N Y., 40 AD2d 159, 161, affd 33 NY2d 980, cert den 417 US 947).
