Order, Supreme Court, Bronx County, entered on April 1,1980, unanimously reversed, on the law, without costs and without disbursements and defendant-appellant’s motion to vacate, sever and dismiss plaintiffs’ complaint as to him and to dismiss defendant-respondent’s cross complaint granted.
