Judgment, insofar as it imposes sentence, unanimously reversed and otherwise judgment affirmed and defendant remanded to Erie County Court for further proceedings, in accordance with the following memorandum: At sentencing, defendant challenged the validity of a predicate felony conviction stating: “I feel very strongly [that] at the time * * * of my sentencing, I was forced to take a cop-out. I made motions myself in New York City and at the last minute I was forced to take a cop-out to one and one-half to three, because the man was 85 years old”.
