People v. Vitale

—Appeal by defendant from a judgment of the Supreme Court, Queens County (Zelman, J.), rendered December 19, 1983, convicting him of attempted robbery in the second degree, upon a jury verdict, and imposing sentence.

Judgment affirmed.

Defendant’s contentions are either unpreserved for appellate review or without merit. Under the facts of this case, we decline to exercise our interest of justice jurisdiction. Brown, J. P., Rubin, Lawrence and Kooper, JJ., concur.
