Thompson v. Hillery
Appellate Division of the Supreme Court of New York · Decided February 13, 1990
158 A.D.2d 525; 551 N.Y.S.2d 290; 1990 N.Y. App. Div. LEXIS 1823
Thompson v. Hillery

Opinion of the Court

The extraordinary remedy of a writ of prohibition does not properly lie under the instant circumstances in view of the availability of an adequate remedy at law (see, Matter of Lipari v Owens, 70 NY2d 731; Matter of Motea v Marasco, 64 NY2d 718). Mollen, P. J., Mangano, Thompson, Rubin and Sullivan, JJ., concur.
