Opinion of the Court
Order modified on the law and as modified affirmed without costs, in accordance with the following memorandum: In this action for libel arising out of defendant newspaper’s publication of an altered wire service story deliberately misidentifying plaintiff, a former employee of defendant, as a suspected burglar, the court erred in granting defendant summary judgment dismissing plaintiff’s claim for punitive damages. In order to prevail on its motion, defendant was required to establish by proof in admissible form that there are no genuine issues of material fact and that it is entitled to judgment as a matter of law (see, Zuckerman v City of New York, 49 NY2d 557, 562). We have considered the contentions raised on defendant’s cross appeal and conclude that they are without merit.
