Opinion of the Court
—Appeal from a judgment of the County Court of Montgomery County (Sise, J.), rendered June 23, 1997, convicting defendant upon his plea of guilty of the crime of sodomy in the third degree.
Defendant pleaded guilty to the crime of sodomy in the third degree as a result of his 1996 molestation of his 14-year-old stepdaughter with the understanding that he would be sentenced to a prison term of lVs to 4 years. Inasmuch as the record reflects that defendant knowingly and voluntarily waived his right to appeal as part of his guilty plea, his contention that this sentence is harsh and excessive has not been preserved for our review (see, People v Leibach, 249 AD2d 636).
