Miller v. Weiner
Appellate Division of the Supreme Court of New York · Decided February 7, 2000
269 A.D.2d 372; 702 N.Y.S.2d 563; 2000 N.Y. App. Div. LEXIS 1246
Miller v. Weiner

Opinion of the Court

β€”In an action to recover damages for personal injuries, the defendants appeal from an order of the Supreme Court, Richmond County (Mastro, J.), dated September 24, 1998, which denied their motion for summary judgment dismissing the complaint.

Ordered that the order is affirmed, with costs.

The Supreme Court properly found that there are issues of fact requiring the denial of summary judgment. Mangano, P. J., Bracken, Joy and H. Miller, JJ., concur.
