Opinion of the Court

Judgment, Supreme Court, New York County (Jeffrey Atlas, J.), rendered June 25, 2002, convicting defendant, upon his plea of guilty, of one count of assault in the first degree, and sentencing him to a term of 10 years, unanimously modified, as a matter of discretion in the interest of justice, to reduce the sentence to a term of seven years, and otherwise affirmed.

We find the sentence excessive to the extent indicated. Concur — Saxe, J.P., Sullivan, Williams, Lerner and Friedman, JJ.
