Opinion of the Court
Appeal from a judgment of the Erie County Court (Michael F. Pietruszka, J.), rendered January 9, 2003. The judgment convicted defendant, upon his plea of guilty, of robbery in the second degree and attempted robbery in the second degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
Memorandum: Defendant appeals from a judgment convicting him upon a plea of guilty of robbery in the second degree (Penal Law § 160.10 [2] [b]) and attempted robbery in the second degree (§§ 110.00, 160.10 [2] [a]). We agree with defendant that the record of the plea colloquy fails to establish that his waiver of the right to appeal was knowing, voluntary and intelligent. County Court’s “single reference to defendant’s right to appeal is insufficient to establish that the court ‘engage[d] the defendant in an adequate colloquy to ensure that the waiver of the right to appeal was a knowing and voluntary choice’ ” (People v Brown, 296 AD2d 860, 860 [2002], lv denied 98 NY2d 767 [2002], quoting People v Kemp, 255 AD2d 397, 397 [1998]).
