Opinion of the Court
Appeal from an amended order of the Monroe County Court (Stephen K. Lindley, A.J.), dated December 17, 2004. The amended order granted defendant’s motion to vacate a judgment of conviction pursuant to CPL 440.10 and granted a new trial.
It is hereby ordered that the amended order so appealed from be and the same hereby is unanimously reversed on the law, the motion is denied and the judgment is reinstated.
Memorandum: The People appeal from an amended order granting defendant’s motion to vacate a judgment of conviction pursuant to CPL 440.10 on the ground that defense counsel’s strategy of conceding defendant’s guilt to the lesser included charge of robbery in the second degree was the equivalent of entering a guilty plea for defendant and was made without defendant’s consent in violation of the right of defendant to make fundamental decisions at trial (see Jones v Barnes, 463 US 745, 751 [1983]; People v White, 73 NY2d 468, 478 [1989], cert denied 493 US 859 [1989]; People v Ferguson, 67 NY2d 383, 390 [1986]).
