Opinion of the Court
Appeal from a judgment of the Supreme Court, Erie County (Ronald H. Tills, A.J.), rendered February 27, 2004. The judgment convicted defendant, upon her plea of guilty, of grand larceny in the second degree and filing a false or fraudulent New York State tax return.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
Memorandum: Defendant appeals from a judgment convicting her upon her plea of guilty of, inter alia, grand larceny in the second degree (Penal Law § 155.40 [1]). The charges arose in connection with the filing of claims for Medicaid reimbursement by defendant, as an agent for a hospital in Pennsylvania, for services that she knew were not provided.
