Jackson v. Cobert

Opinion of the Court

OPINION OF THE COURT

Memorandum.

Judgment unanimously affirmed without costs.

The evidence adduced upon the trial was sufficient to support the lower court’s finding that plaintiffs had not breached *771the terms of the contract of sale and. were therefore entitled to the return of their down payment. We find defendants’ other contentions raised on appeal to be equally without merit. Aronin, J. P., Chetta and Patterson, JJ., concur.
