LAURA TAYLOR SWAIN, Chief United States District Judge: Plaintiff filed this action pro se. For the reasons discussed below, within 30 days of the date of this order, Plaintiff must submit a completed signed amended complaint, and either pay the $402.00 in filing fees that are required to file a civil action in this Court or submit an in forma pauperis (IFP) application.
Plaintiff submitted an incomplete complaint without any facts, and without an original signature, in which she only names the defendants and asserts that her federal constitutional and statutory rights were violated. Rule 8(a) of the Federal Rules of Civil Procedure provides that a complaint contain “(1) a short and plain statement of the grounds for the court’s jurisdiction . . . ; (2) a short and plain statement of the claim showing that the pleader is entitled to relief; and (3) a demand for the relief sought, which may include relief in the alternative or different types of relief.” Fed. R. Civ. P. 8(a). In addition, Rule 11(a) of those same rules states that “[e]very pleading, written motion, and other paper must be signed by at least one attorney of record in the attorney’s name – or by a party personally if the party is unrepresented.” Fed. R. Civ. P. 11(a); see Local Civil Rule 11.1(a). The Supreme Court of the United States has interpreted Rule 11(a) to require “as it did in John Hancock’s day, a name handwritten (or a mark handplaced).” Becker v. Montgomery, 532 U.S. 757, 764 (2001).
To proceed with this action, Plaintiff is directed to submit an amended complaint with an original signature to the court within 30 days of the date of this order. In the amended complaint, Plaintiff must provide a short and plain statement that puts defendants on notice of the claims against them. If Plaintiff submits the amended complaint, it should be labeled with docket number 23-CV-4590 (LTS).
Furthermore, to proceed with a civil action in this Court, a plaintiff must either pay $402.00 in fees – a $350.00 filing fee plus a $52.00 administrative fee – or, to request authorization to proceed without prepayment of fees, submit an IFP application. See 28 U.S.C. §§ 1914, 1915.
Plaintiff submitted the complaint without the filing fees or an IFP application. She must, within 30 days, either pay the $402.00 in fees or submit an IFP application. If Plaintiff submits an IFP application, it should also be labeled with docket number 23-CV-4590 (LTS). If the Court grants the IFP application, Plaintiff will be permitted to proceed without prepayment of fees. See 28 U.S.C. § 1915(a)(1).
CONCLUSION The Court directs Plaintiff to submit, within 30 days, an amended complaint that complies with Rules 8(a) and 11(a) of the Federal Rules of Civil; it must allege facts to state a claim and include an original signature. Plaintiff must also either pay the $402.00 in fees or submit an IFP application within that period of time. No summonses shall issue at this time. If Plaintiff complies with this order, the case shall be processed in accordance with the procedures of the Clerk’s Office. If Plaintiff fails to comply with this order within the time allowed, the action will be dismissed.
The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue).
