It is hereby ORDERED, ADJUDGED AND DECREED: That for the reasons stated in the Court's Opinion and Order dated October 24, 2023, the Court has considered the entirety of Acosta's arguments and finds them to be without merit. His motion to vacate, set aside or correct his conviction and sentence pursuant to

28 U.S.C. § 2255

is DENIED. Acosta has not made a substantial showing of the denial of a constitutional right, and accordingly, a certificate of appealability will not issue.
