EDGARDO RAMOS, United States District Judge: Using the court’s general complaint form, Plaintiff, who is proceeding pro se and in forma pauperis (IFP), alleges that Defendant sexually assaulted her. Doc. 1. Attached to the complaint are approximately 60 pages of documents, some of which are of a sensitive nature. Id. at 8–70. By order dated April 16, 2024, the Court alerted Plaintiff that: (1) it was construing her complaint as asserting state-law tort claims under the Court’s diversity of citizenship jurisdiction; and (2) the inclusion of the documents violated Federal Rule of Civil Procedure 5.2. Doc. 5. The Court directed Plaintiff to file an amended complaint that complied with Rule 5.2, and attached to the order an Amended Complaint form for Plaintiff to use. Id. On May 14, 2024, Plaintiff submitted an unsigned letter asserting the same general allegations about the events giving rise to this action. Doc. 7. DISCUSSION A. Subject matter jurisdiction Plaintiff’s allegations of sexual assault arise under state law. To file state-law claims in this Court, Plaintiff must allege that the Court has diversity of citizenship jurisdiction. Under
28 U.S.C. § 1332, as relevant here, a plaintiff must allege that the plaintiff and the defendant are citizens of different states. Wis. Dep’t of Corr. v. Schacht,
524 U.S. 381, 388(1998). For diversity purposes, an individual is a citizen of the state where she is domiciled, which is defined as the place where the individual “has [her] true fixed home . . . and to which, whenever [she] is absent, [s]he has the intention of returning.” Palazzo ex rel. Delmage v. Corio,
232 F.3d 38, 42(2d Cir. 2000) (citation omitted).
In the original complaint, Plaintiff stated that she was a citizen of New Jersey and that Defendant was a citizen of New York. Doc. 1 at 2–3. But in the letter Plaintiff submitted on May 14, 2024, which replaced the original complaint, Plaintiff did not address the issue of the parties’ citizenship at all. Because Plaintiff does not allege that she is a citizen of New Jersey and that Defendant is a citizen of New York, the Court cannot determine from the letter whether the parties are diverse. If Plaintiff wishes to pursue her state-law claims under the Court’s diversity jurisdiction, she must reallege those claims in an amended complaint. Because Plaintiff’s amended complaint will completely replace, not supplement, the original complaint, any facts or claims that Plaintiff wants to include from the original complaint—including the citizenship of the parties—must be
repeated in the amended complaint. The Court strongly encourages Plaintiff to use the Amended Complaint form attached to this order, because it will guide Plaintiff to provide all the information that the Court needs so that this matter can proceed. Plaintiff is reminded that she need not attach any documents to her amended complaint, but if she does attach documents, they must comply with Rule 5.2, as set forth in the Court’s April 16, 2024, order. Doc. 5. B. Original signature Additionally, Federal Rule of Civil Procedure 11(a) provides that “[e]very pleading, written motion, and other paper must be signed . . . by a party personally if the party is unrepresented.” Fed. R. Civ. P. 11(a); see Becker v. Montgomery,
532 U.S. 757, 764(2001) (interpreting Rule 11(a) to require, “as it did in John Hancock’s day, a name handwritten (or a mark handplaced)”).! Plaintiff did not sign the May 14 letter. Any document that Plaintiff submits to the Court must be signed. Plaintiff is directed to sign the amended complaint, and any other documents that she files going forward. CONCLUSION Plaintiff is directed to file an amended complaint that complies with the standards set forth above. Plaintiff must submit the amended complaint to this Court’s Pro Se Intake Unit within 30 days of the date of this order, caption the document as an “Amended Complaint,” and label the document with docket number 24-CV-01757 (ER). An Amended Complaint form is attached to this order. No summons will issue at this time. If Plaintiff complies with this order, the Court will issue an order of service. If Plaintiff fails to comply within the time allowed, and she cannot show good cause to excuse such failure, the complaint will be dismissed without prejudice. SO ORDERED.
