Order reversed, with ten dollars costs and disbursements, and the motion to appoint a receiver granted of that portion of the real estate which wasj at the date of the motion, rented, but not to include that portion occupied by the plaintiff and defendant as residents. The case is remitted to the Special Term to appoint a proper person receiver and fix the amount of security to he given. Order to be settled by Haight, J.; opinion by
