Per Curiam.

We think that the judgment should be affirmed upon the opinion of Mr. Justice Andrews, (19 N. Y. Supp. 16,) handed down upon the previous appeal in thisvaction, which opinion this court adopts for the purposes of this appeal. The judgment should be affirmed, with costs.
