Concur: Hiscock, Chase, Cuddeback, Hogan, Cardozo and Pound, JJ.; Willard Bartlett, Ch. J., concurs solely on the authority of People v. Lammerts (164 N. Y. 137). Were it not for that decision he should deem the indictment fatally defective.
