Concur: Chief Judge Conway and Judges Desmond, Dye, Fuld, Froessel and Burke. Judge Van Voorhis dissents and votes to reverse and to dismiss the information upon the ground that the article sold on Sunday was a useless knictimack which, in common parlance, amounted to a souvenir which is within the class of excepted articles permitted to be sold on that day by section 2147 of the Penal Law.
