Motion by landlord to dismiss appeal taken as of right granted and appeal dismissed, with costs and $20 costs of motion, and cross motion by tenant for leave to appeal dismissed, upon the ground that neither the appeal nor the motion for leave to appeal lies (NY Const, art VI, § 3; CPLR 5601, 5602). Motion by landlord for injunctive relief dismissed upon the ground that the Court of Appeals does not have jurisdiction to grant the relief requested.
