The two proceedings pending in this estate are consolidated by the court and will be disposed of at the time of the return of the citation in the probate proceeding. The motion pursuant to subdivision 3 of rule 107 of the Buies of Civil Practice, is denied.

The construction proceeding will await determination of the validity of the propounded instrument.
