Ohio Court of Appeals · Decided March 27, 1998

Federal Sav. Loan Ass. v. a M Ser., Unpublished Decision (3-27-1998)

Opinion of the Court

MISCELLANEOUS/REPLEVIN:

The posting of a bond is not a prerequisite to proceeding with a replevin action because the bond procedures in R.C. Chapter 2737 are applicable only when the parties to the action would like possession of the chattel during the pendency of the replevin action.

SECURED TRANSACTIONS:

When the record only demonstrates that a vehicle was stolen, R.C. 4513.61 is inapplicable because that statute only applies to abandoned vehicles.
