Banks v. Banks, Unpublished Decision (3-27-1998)

Opinion of the Court

DOMESTIC RELATIONS/CHILD SUPPORT:

When calculating an obligation of child support, the trial court must take into account the potential income of a parent who is unemployed or underemployed. See R.C. 3113.215(A)(1)(b) and (B) (1). When an appellate court is reviewing this determination, the appellate court must be able to ascertain from the trial court's journal entry the amount of potential income imputed and the reasons for imputing said income.
