JOURNAL ENTRYOn February 16, 2005, this Court issued an opinion in this matter, affirming in part and reversing in part the judgment of the Summit County Court of Common Pleas. On February 22, 2005, Appellees filed a motion to correct our decision. Page 11 of the opinion incorrectly taxed costs to the parties equally. As Appellees were the prevailing party in all aspects of the appeal, line 4 on page 11 should be corrected to read:

"Costs taxed to Appellant."
