RECOMMENDATION Plaintiff originally filed this employment discrimination action in the Hamilton County, Ohio Court of Common Pleas on November 13, 2019, alleging claims under 42 U.S.C. § 1981a, Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq., and state law. (Doc. 1, Exh. A). Defendant removed the action to this Court on February 11, 2020. (Doc. 1). Defendant filed a motion to dismiss the complaint on March 25, 2020. (Doc. 6). Plaintiff filed an amended complaint on April 13, 2020. (Doc. 7). On April 23, 2020, defendant filed an answer to the amended complaint. (Doc. 8). Plaintiffs amended complaint supersedes the original complaint and is the “legally operative complaint” in this matter. Scuba v. Wilkinson, No. 1:06-cv-160,

NOTICE
