Opinion of the Court

Peck, J.

This is a petition in error to reverse an order of appropriation of land, like that in the preceding case of Harbeck et al. v. The City of Toledo, made by Judge Fitch of the Lucas common pleas, in March 1855, for the purpose-of widening the extension of Ottawa street, and is liable to the same objections.

Order reversed.
