Opinion of the Court

By the Court.

Held: Where, in a prosecution to keep the peace, the defendant is held to bail or committed, and *430adjudged to pay the costs of prosecution, but proves to be insolvent, so that the costs can not be collected from him, there is no statute requiring the payment of such costs from ■ the county treasury.
