It is ordered and adjudged by this court, that.the judgment of the said circuit court which reversed the judgment of the court of common pleas is hereby affirmed; but the further judgment rendered by the said circuit court against the plaintiff in error is hereby reversed and held for naught, and this cause is remanded to the court of common pleas for further proceedings according to Igw.
