It is hereby ordered and adjudged by this court, that the judgment of the said circuit court be, and the same hereby is, affirmed in all respects except as to the claim of $36.00 for lumber left in the sewer trench, and as to this item the judgment of the circuit court is reversed and that of the common pleas is affirmed at the costs of the defendant in error.
